Distinguished Senior Advocate Fali S. Nariman Passes Away at 95

Fali S. Nariman, widely recognized as the “Bhishma Pitaamah” or father figure of the Indian judiciary, passed away early on Wednesday at the age of 95. A Padma Vibhushan awardee, Nariman played a pivotal role in shaping historic rulings through his brilliant advocacy and eloquent oratory skills.

His significant contributions to landmark cases, including the Golak Nath case, TMA Pai case, and SP Gupta and NJAC case, have left an indelible mark on the legal landscape, redefining the interpretation of the Constitution.

As a seasoned attorney for over 70 years, Nariman practiced law at the Bombay High Court and later at the Supreme Court. His commitment to principles was evident when he resigned as additional solicitor-general of India on the day of the emergency declaration in 1975. Nariman’s legacy extends beyond the courtroom, as he was a prolific writer and a former member of the Rajya Sabha. Some of his notable works include “God Save the Hon’ble Supreme Court. Before the Memory Fades,” “The State of the Nation,” and “India’s Legal System: Can It Be Saved?”

Born on January 10, 1929, in Rangoon, British India, Fali S. Nariman influence on jurisprudence and his advocacy for the autonomy of the judiciary in judge appointments have been widely acknowledged. His son, Justice Rohinton F. Nariman, also served as a Supreme Court judge. Senior Advocate Abhishek Manu Singhvi hailed Nariman as a living legend, emphasizing his significant impact on legal and public life.

Attorney General Tushar Mehta expressed deep sorrow at the loss of an intellectual giant, describing Fali S. Nariman as an icon of justice. Mehta highlighted that even facing Nariman in court was a learning experience, and such towering intellects never truly fade away. Fali Nariman, he noted, is a unique and irreplaceable figure in the annals of jurisprudence, leaving an enduring legacy.
