Gyanvapi Masjid Committee Appeals to Allahabad High Court for Resolution

The Muslim faction alleges that the administration Gyanvapi masjid deliberately opened the Vyas Tehkhana clandestinely, during the night, in an effort to obstruct their access to any relief.

As reported by livelaw, the Gyanvapi masjid committee has contested the Varanasi district court’s decision, granting permission to Hindus for conducting puja in the Vyas Tehkhana (southern cellar of the Gyanvapi building), and has taken the matter to the Allahabad High Court.

Marking the first occurrence in thirty-one years, prayers were conducted at midnight shortly after the court directive. The Muslim side declared their intention on Wednesday to file an appeal with the Allahabad High Court, asserting that certain aspects of the Varanasi district court’s ruling were overlooked.

The Muslim faction contends that the Hindu side has failed to provide evidence of prayers being held before 1993, despite supporting documents such as the Advocate Commissioner report from 2022, the ASI report, and the 1937 ruling, all favoring the Muslim perspective. The most recent developments include the initiation of puja at the Vyas Tahkhana of the Gyanvapi mosque.

The Chief Justice of India has urged the attorney for the Anjuman Intezamia Masjid Committee to file an urgent motion for a hearing on Thursday, as conveyed by the Supreme Court register.
Despite the trial court’s directive, the administration’s decision to expedite the task during the night lacks justification.
The Muslim side contends that the administration, in collaboration with the plaintiffs, is attempting to preempt the Mosque Managing Committee’s legal remedies against the aforementioned order.
This hasty approach is seen as a deliberate strategy to obstruct the Committee, and the Muslim faction questions the administration’s motives.
In a groundbreaking verdict on Wednesday, the Varanasi court granted permission for Hindu devotees to offer prayers in the Vyas ka Tahkhana area within the Gyanvapi mosque complex. The court has mandated the district administration to make necessary preparations within the next seven days.
After a hiatus of 31 years, the Tehkhana was opened later that night, and prayers were conducted. The mosque’s basement contains four tahkhanas or cellars, with Vyas Tahkhana presumed to be associated with the Vyas family.
Residents reported the cellar being cleaned, and religious rituals, including aarti for Goddess Lakshmi and Lord Ganesh, were performed.
Around 9:30 p.m on Wednesday night, members of the Kashi-Vishwanath temple trust were summoned, and barriers in front of the Nandi statue facing the mosque’s wazu khana were removed. The ASI survey indicates that the Gyanvapi mosque was constructed over the remains of a Hindu temple during Aurangzeb’s reign.
